This article discusses deontic modality in the context of legal documents and its divergence from the natural, conventional, interpretation. This work demonstrates that the meaning of the performative verb is not purely linguistic. A number of non-linguistic factors cause the variation of meanings of performatives, in this case, when expressing prohibition, permission, recommendation, advice, proposal or request. These factors include: status of the addressee, type of the relationship between the author and the addressee, type of the document, possibility of control (...) and subsequent punishment for the breach of a norm, methodology of legal drafting, traditions of the Russian document processes. There is no direct association between the type of the legal norm and the meaning of the performative. To express its will, a regional law-maker, to a varying degree, uses orders, prohibition and permissions. These are dictated by the type of the document. (shrink)

The current study investigates the influence of variety among online providers and customers' access to knowledge on consumer networks, consumer engagement, and sustainable purchasing. Emphasis is on the underlying relationships among these constructs in the digital economy, which has evolved into a complex structure of multifarious nodes and linkages unfolding in the online environment. The underlying theoretical approaches are knowledge-attitude-behavior (KAB) and customer sovereignty. Against this backdrop, a questionnaire-based survey was given to 200 Millennials (i.e., generation Y) and gen Z (...) Italians—approached as empowered stakeholders requiring accurate information and sustainable solutions from online providers—in January 2023. The data was processed via the structural equation modeling technique PLS-SEM, based on SmartPLS 4. The findings indicated that sustainable purchasing is influenced to some extent by access to knowledge, consumer engagement, and consumer networks. The study endeavors to fill a research gap, as the relationships between variety among online providers and sustainable purchasing, as well as consumer engagement from the empowerment perspective are underexplored. The study provides new evidence of the relationships between consumer networks, consumers' access to knowledge, sustainable purchasing, and consumer engagement in the framework of online retail by inquiring respondents. Tematyka prepozytury szpitalnej w Zebrzydowicach jest ściśle związana z osobą Mikołaja Zebrzydowskiego, który w 1599 roku ufundował w rodowej siedzibie szpital dla 12 weteranów wojskowych, przede wszystkim dla tych, którzy należeli do bractwa żołnierskiego świętego Michała Archanioła założonego przez wojewodę w 1596 roku. W jego zamierzeniu przebywający tam chorzy mieli otrzymać odpowiednią opiekę zarówno dla ciała, jak i dla duszy, dlatego też zarząd przytułku oraz troskę o potrzeby pacjentów zostały powierzone miejscowemu proboszczowi, który był zarazem prepozytem tegoż szpitala. Z czasem (...) okazało się, iż takie rozwiązanie nie zadowalało fundatora i ostatecznie zdecydował on o przekazaniu tego dzieła braciom bonifratrom, których sprowadził do Zebrzydowic z Krakowa w 1611 roku. W niniejszym artykule został ukazany jeden z etapów procesu poszukiwania lepszego sposobu na zarządzanie równocześnie fundacją i parafią, który Zebrzydowski spróbował wcielić w życie już w 1601 roku. Niepublikowany dotąd dokument biskupa Bernarda Maciejowskiego z 3 sierpnia 1601 roku, oblatowany w aktach czynności biskupa krakowskiego (edycja wraz z tłumaczeniem w aneksie), wprowadzał rozwiązanie dążące do utrzymania prepozytury kosztem miejscowej parafii, zaś osobą łączącą obie jednostki administracyjne miał być od tej pory prepozyt, a nie proboszcz. Dokument ten stanowi zarazem ciekawy przykład współpracy biskupa ze szlachtą w sprawach kościelnych, co było niezwykle istotne w ówczesnym systemie zależności pomiędzy kolatorami miejscowego kościoła a biskupem ordynariuszem, odpowiedzialnym za całość życia kościelnego na terytorium zarządzanej przez siebie diecezji. Oddajemy czytelnikom kolejny numer „Rocznika Filozoficznego Ignatianum”. Prawie w całości poświęcony został on Mikołajowi Zebrzydowskiemu. Stan badań na jego temat zarysowany został w pierwszym tekście autorstwa Elżbiety E. Wróbel i Tomasza Graffa. Drugi z wymienionych autorów w osobnym artykule przedstawił także problematykę związaną z rozwojem majątku Floriana Zebrzydowskiego w miarę wzrostu jego znaczenia politycznego na dworze króla Zygmunta Augusta. Szczególny nacisk położono na studium przypadku (_case study_). Autor analizuje bowiem nabycie przez Zebrzydowskiego dóbr w Radoczy koło Wadowic, ukazując perspektywę konieczności (...) podjęcia dalszych badań nad powiększeniem majątku Floriana Zebrzydowskiego i jego rodziny. Artykuł wieńczy aneks, wraz z edycją w języku łacińskim i polskim tłumaczeniu dokumentu, w którym „Zygmunt August nadaje Florianowi Zebrzydowskiemu prawo zbudowania tamy na rzece Skawie i poprowadzenia stamtąd wody fosą przez ziemie dóbr Wadowice dla zbudowania stawów rybnych w dobrach Radocza”_._. COVID-19 pandemic-related perceived risk of infection, illness fears, acute stress, emotional anxiety, exhaustion, and fatigue, psychological trauma and depressive symptoms, and sustained psychological distress can cause smartphone addiction risk and lead to technology-related cognitive, emotional, and behavioral disorders, thus impacting psychological well-being. Behavioral addiction of smartphone users can result in anxiety symptom severity, psychiatric symptoms, and depressive stress. We carried out a quantitative literature review of the Web of Science, Scopus, and ProQuest throughout June 2022, with search terms including “smartphone (...) addiction + COVID-19” + “stress,” “anxiety,” “depression,” “psychological distress,” “screen time,” and “fear.” As we analyzed only articles published between 2020 and 2022, 288 papers met the eligibility criteria. By excluding sources with similar titles, having unclear findings or unsupported by replication, or displaying inconsistent content, we selected 64, mainly empirical, sources. We used layout algorithms and bibliometric mapping as data visualization tools. Assessing the Methodological Quality of Systematic Reviews, a systematic review and literature review software, Mixed Methods Appraisal Tool, and Systematic Review Data Repository were employed as methodological quality assessment tools. As limitations, we analyzed only articles published between 2020 and 2022 in scholarly outlets indexed in the Web of Science, Scopus, and ProQuest databases. The scope of our study also does not advance the inspection of sources covering vulnerable individuals suffering from certain diseases or specific generations. Subsequent analyses should develop on smartphone use and addiction among children and adolescents. Future research should thus investigate problematic smartphone use and addiction across generations Z and Alpha. Attention should be directed to their personality traits and psychopathological symptoms. (shrink)

Artykuł ukazuje w ujęciu problemowym stan badań nad postacią Mikołaja Zebrzydowskiego (1553–1620) oraz jego rodziny do roku 2022. Zwrócono uwagę na najważniejsze publikacje dotyczące jego biografii, fundacji oraz działalności politycznej. Zauważono, że dotychczasowa historiografia zajmowała się Zebrzydowskim głównie w kontekście rokoszu sandomierskiego, fundacji klasztoru, kalwarii oraz fundacji w rodowych Zebrzydowicach. Natomiast genealogią rodziny Zebrzydowskich, ich majątkiem oraz powiązaniami z innymi rodami zajmowano się sporadycznie. Nieco szerzej analizowano działalność Floriana Zebrzydowskiego, ojca Mikołaja, jednak głównie jako teoretyka wojskowości. Autorzy podkreślają szczególnie znaczenie (...) rocznicy 400-lecia śmierci wojewody krakowskiego, która przypadła na rok 2020. Przyczyniła się ona do intensyfikacji badań nad biografią Mikołaja Zebrzydowskiego i jego rodziną, co zaowocowało m.in. wydaniem dwóch monografii: szkicu biograficznego oraz pracy zbiorowej. W podsumowaniu artykułu nakreślono perspektywy badawcze dotyczące biografii wojewody krakowskiego i jego rodziny, zauważając m.in. konieczność rozszerzenia kwerend w archiwach krajowych i zagranicznych. The current research is based on Senninger’s Learning Zone Model applied to the tourists’ comfort zone. This model was created in 2000 and it proved to be useful in many applied areas: Psychology, Sociology, Marketing and Management. This modes is a behavioral one and shows how a person can justify his action based on previous tested experiences or dares to step beyond in fear, learn or growth zone. Our research is extending the existent area of expertise to tourism. We aimed (...) at exploring whether the tourists’ apprehension toward choosing their next destination from a comfort zone perspective or rather from the other zones’ perspectives such as fear, learning or growth. To meet this purpose we conducted a mixed method: firstly a qualitative one, an in-depth interview based on Delphi method with 10 tourism specialists and secondly an online survey on 208 Generation Z tourists. The interviews were meant to help developing a 20 items scale to measure from which of the 4 zones are the respondents making the choice of the future travel destination. Our conclusions show that Gen Z tourists display behaviors that can be associated with learning or growth zones rather than the comfort zone. This is relevant when choosing the next travel destination, because our findings could bring about a new approach to promoting tourist destinations as part of various products. As a result, a large range of managerial tools can better adapt the promotion messages to the target market from a new psychological perspective. (shrink)

Studie analyzuje podmínky a specifika, která vedla k tomu, že v roce 1678 získala na Univerzitě v Padově jako první žena na světě doktorát z filozofie Elena Lucrezia Cornaro Piscopia. Autorka zpřítomňuje širší dobový kontext, který rámcoval tuto výjimečnou událost. Upozorňuje na to, že i navzdory skutečnosti, že univerzity neumožňovaly řádné studium ženám, se Eleně Cornaro získat doktorát podařilo, a to díky souběhu několika okolností, které vytvořily příznivé podmínky pro jeho udělení této ženě. Z nich autorka vyzdvihuje zejména tradici (...) intelektuálních center na renesančních dvorech na území dnešní Itálie, vedených vzdělanými aristokratkami; rozvoj Benátské republiky v 16. a 17. století, který ovlivnil i postavení žen, zejména z aristokratických rodin; tradice aristotelismu na italských univerzitách a otevřený přístup, zejména Univerzity v Padově a v Bologni, ke studiu žen. Hlavní pozornost je věnována rodinnému prostředí, životním osudům a studiu Eleny Cornaro. Na závěr je krátce pojednáno o osudu této ženy v historické paměti, zmíněny jsou další filozofky a vědkyně 17. a 18. století a je nastolena otázka, zda Elena Cornaro napomohla ke změně postoje univerzit ke vzdělání žen. Slurs have become a big topic of discussion both in philosophy and in linguistics. Slurs are usually characterised as pejorative terms, co-extensional with other, neutral, terms referring to ethnic or social groups. However, slurs are not the only ethnic/social words with pejorative senses. Our aim in this paper is to introduce a different kind of pejoratives, which we will call “ethnic/social terms used as insults”, as exemplified in Spanish, though present in many other languages and mostly absent in English. These (...) are ethnic terms like gitano, ‘Romani’, which can have an extensional and neutral use, but also a pejorative meaning building on a negative stereotypical representation of the Romani community. We introduce a probabilistic extension of propositional intuitionistic logic. The logic allows making statements such as P≥sα, with the intended meaning “the probability of truthfulness of α is at least s”. We describe the corresponding class of models, which are Kripke models with a naturally arising notion of probability, and give a sound and complete infinitary axiomatic system. We prove that the logic is decidable.

The concept of nature in Western thought has been informed by the assumption of a categorical distinction between natural and artificial entities, which goes back to John Stuart Mill or even Aristotle. Such a way of articulating the natural/artificial distinction has proven unfit for conservation purposes mainly because of the extent and the pervasiveness of human activities that would leave no nature left to be conserved, and alternative views have been advanced. In this contribution, after arguing for the importance of (...) the concept of naturalness as a guide for conservation, I will try to provide an account of the natural/artificial distinction suited to contemporary conservation framing. Focusing on a particular kind of objects that I suggest to name “environmental objects”, I propose and defend the view of “naturalness as independence” according to which the more or less an environmental object's identity conditions and survival depend on human intervention, the more or less that object is artificial or natural, respectively. According to this view, conserving environmental objects will equate to maintaining or improving their naturalness or even originating artificial objects that may become new natural objects. This view has the advantage, on the one hand, of providing a rationale for a distinction which is not only part of how people think, but also pervasive in conservation practices and policies and, on the other hand, of accounting for the global pervasiveness of human intervention in the so-called natural world. In the context of astrophysical modeling at the solar system scale, we investigate the modalities implied by taking into account different levels of detail at which phenomena can be considered. In particular, by framing the analysis in terms of the how-possibly/how-actually distinction, we address the debated question as to whether the degree of plausibility is tightly linked to the degree of detail. On the grounds of concrete examples, we argue that, also in the astrophysical context examined, this is not necessarily (...) the case. (shrink)

Visuo-motor adaptation to optical prisms displacing the visual scene (prism adaptation, PA) is a method used for investigating visuomotor plasticity in healthy individuals and, in clinical settings, for the rehabilitation of unilateral spatial neglect. In the standard paradigm, the adaptation phase involves repeated pointings to visual targets, while wearing optical prisms displacing the visual scene laterally. Here we explored differences in PA, and its aftereffects (AEs), as related to the sensory modality of the target. Visual, auditory, and multisensory - audio-visual (...) - targets in the adaptation phase were used, while participants wore prisms displacing the visual field rightwards by 10◦. Proprioceptive, visual, visual-proprioceptive, auditory-proprioceptive straight-ahead shifts were measured. Pointing to auditory and to audio-visual targets in the adaptation phase produces proprioceptive, visual-proprioceptive, and auditory-proprioceptive AEs, as the typical visual targets did. This finding reveals that cross-modal plasticity effects involve both the auditory and the visual modality, and their interactions (Experiment 1). Even a shortened PA phase, requiring only 24 pointings to visual and audio-visual targets (Experiment 2), is sufficient to bring about AEs, as compared to the standard 92-pointings procedure. Finally, pointings to auditory targets cause AEs, although PA with a reduced number of pointings (24) to auditory targets brings about smaller AEs, as compared to the 92-pointings procedure (Experiment 3). Together, results from the three experiments extend to the auditory modality the sensorimotor plasticity underlying the typical AEs produced by PA to visual targets. Importantly, PA to auditory targets appears characterized by less accurate pointings and error correction, suggesting that the auditory component of the PA process may be less central to the building up of the AEs, than the sensorimotor pointing activity per se. These findings highlight both the effectiveness of a reduced number of pointings for bringing about AEs, and the possibility of inducing PA with auditory targets, which may be used as a compensatory route in patients with visual deficits. How should his dialogues be read (does the literary form matter, for example, to our getting at the heart of what Plato is saying)? These questions are now familiar in contemporary Plato scholarship, and their answers—which undoubtedly are interconnected—are the subject of lively and fascinating exploration. Any doubt that Platonic studies flourishes would quickly be put to rest by the four books under review here.It was once thought that attention to the "dramatic dimension" of Plato's literary-philosophical productions was the province of two much despised schools of thought: "the Straussians," and "the Continentals." The first of these was viewed as advocating a dangerous combination of esotericism (the idea that somehow Plato's meaning is not on the surface of the dialogues, but concealed in them, as though they were a cryptogram), elitism (the idea that the true Plato is only available to [End Page 205] "the few"—such as the Straussians, according to themselves anyhow), and unphilosophical and dilettantish meanderings about this or that literarily cast "teaching." Straussian hermeneutics was thought to open the way to unprincipled appeals to irony whenever it suited the interpreter, so that any text could end up saying pretty much whatever the interpreter wished for it to say, including the opposite of what the surface of the dialogue appeared to say. And further, it was thought (perhaps in a manner at odds with the "unprincipled interpretation" charge) that the Straussians' mode of "taking into account" the dramatic context—and in particular their contextualization of claims made in the dialogues such that this or that claim gets "explained" as a rhetorical gesture addressed by character X to character Y in context Z, a gesture whose content and validity, so to speak, are limited to that exchange—robs the dialogue of its philosophical content. Hence the worry that Straussian hermeneutics leads to skepticism about the possibility of philosophy itself—philosophy understood precisely in the way that it is regularly spoken of in the Platonic dialogues, namely as the effort to transcend perspective and partiality and to grasp through argument the essence of the matter as such. To cap it off, there is the background suspicion that Straussians are politically conservative, in a way that is somehow connected with their interpretation of Plato.There is more than a kernel of truth in the view that Straussians have insisted on the hermeneutic importance of the dialogue form, taking their cue from Strauss's own remarks in such texts as The City and Man. Yet the appeal of technological and scientific solutions to the messy problem of finding partners is hardly new. This introduction to the Focus section “It’s a Match!” argues that the history of amorous matching has long been part and parcel of the history of science, in particular the social sciences. Taking matching as an “applied science of social harmony,” the (...) authors argue that concern over more reliable techniques for determining the suitability of partners has formed an essential part of both the maintenance of social order and the shaping of subjectivities, enabling discourses of informed choice and the rational management of the passions, while also reinforcing and subverting structures of age, gender, race, and sexuality. Kaum eine andere künstlerische Strategie prägte das Wertesystem der Kunst des 20. Jahrhunderts wie die Wiederholung. Sie lässt sich als wesentliches Moment ausmachen, neue Wahrnehmungsweisen zu ermöglichen, Kritik an Formen der Repräsentation zu üben und neuen Sinn zu produzieren. Der Band nimmt eine kritische Revision des Phänomens für die zeitgenössische Kunst vor und eröffnet anhand bildnerischer, skulpturaler, performativer, technisch-medialer wie auch kuratorischer Wiederholungen in der Kunst eine Perspektive auf die Wiederholung als Grundbegriff des Ästhetischen.

The necessity of the study of mistakes of bilingual students in the use of nominal parts of speech is grounded in the article, it provides valuable material for scientific and methodological conclusions, as these mistakes reflect linguistic, psychological and pedagogical aspects that affect the ability of schoolchildren to learn peculiarities of using nominal parts of speech of Russian language. In this regard, ascertaining experiment with pupils of schools with native teaching language was held. Students were offered the tasks based on (...) formation of the four types of competence: language, linguistic, communicative and cultural. The results of the experiment made possible to reveal numerous mistakes in using nominal parts of speech in oral speech and in writing of students. These mistakes are a consequence of the complexity of semantic and grammatical nature of the names in the Russian language, of interfering influence of the native language and as well are explained by the imperfection of the content and methods of teaching nominal parts of speech at school.
